Marcus if the phone as been activated once upon a time it SHOULD work. I would check with Apple on this though. Id hate to see you spend the $$ to get the phone and not have it work as you want it too.

In able for anything to work, it needs a sim card.
and if you dont want AT&T you can still use it as a phone but use another carrier that has the same band [GSM] which leaves you going with either cingular or telstra.
